Birth Injury

Birth injuries
are among the most devastating of injuries. These injuries can result as
a result of the failure on the part of doctors and hospital to provide
appropriate treatment to a laboring mother during the labor and delivery
process. Most often the resultant injuries include quadriplegia and/or
cerebral palsy. Cerebral palsy is a group of disorders that affect a
person's ability to move and to maintain balance and posture.
Birth injuries, including cerebral palsy and quadriplegia, can occur if
there is a failure on the part of the physician and/or nurses to properly
monitor the baby during labor and delivery and notice the signs of
potential fetal distress. If potential fetal distress is noted and if
there is failure to deliver the baby in a timely manner, then the
condition of the baby can proceed from fetal distress to hypoxia
(inadequate oxygen) and ischemia (insufficient blood flow to the brain).
This condition is sometimes known as perinatal asphyxia or hypoxic
ischemic encephalopathy. As a result of inadequate oxygen and blood flow
to the brain, the baby’s brain can become permanently damaged.
Ms. Dentice has unique expertise with cases involving failure to diagnose a
baby’s condition during labor and delivery resulting in quadriplegia and
cerebral palsy. Ms. Dentice has settled and tried to a jury several cases
involving birth injuries. These are very difficult, costly and time
consuming cases.
Ms. Dentice also has unique experience understanding the damages involved
in these most devastating cases. Prior to attending law school, Ms.
Dentice taught handicapped children and was an administrator of programs
for the handicapped. Thus, she is particularly sensitive to the needs of
handicapped children and has a particular sensitivity to these injured
children.
